Welcome to AZ Builders LLC ("AZ Builders," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our main website at https://azbuildersllc.com/, our quote request portal hosted on our GHL subdomain, as well as any related services, content, and features (collectively, the "Services").

2. SERVICES DESCRIPTION

AZ Builders LLC is a residential and commercial construction contractor based in East Wenatchee, Washington. We provide skilled construction services with over 6 years of experience, including but not limited to:

Siding Installation — including LP SmartSide, fiber cement, wood, metal, vinyl, cedar, pine, and more

Finish Carpentry — trim work, window casing, millwork, paneling, stairs, baseboards, and related finish work

Window Installation — for residential and commercial projects, including new construction and replacements

Door Installation — interior, exterior, and custom doors for residential and commercial properties (glass doors not included)

General Carpentry — installation of doors, cabinets, trim work, and other wooden components

We deliver consistent quality work on time, built on trust and integrity. Our services are available to clients in East Wenatchee, WA and surrounding areas.

3. ELIGIBILITY

You must be at least 18 years of age to use our Services and to enter into a construction services agreement with AZ Builders LLC.

4. USER ACCOUNTS AND REGISTRATION

4.1 Submitting Requests

When you submit a quote request or contact us through our Services, you agree to provide accurate, current, and complete information about yourself and your project. You are responsible for the accuracy of any information you submit.

4.2 Account Security

If you create an account with us, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

5. QUOTES, SCHEDULING, AND CANCELLATION POLICY

5.1 Quote Requests

Quote requests submitted through our Services are not binding agreements. A binding agreement for construction services is only formed once a written estimate or contract has been signed by both parties.

5.2 Scheduling

We schedule on-site visits, consultations, and project work based on availability and project scope. We will communicate scheduling details directly with you after a quote request is received.

5.3 Cancellations and Rescheduling

We ask that you provide as much advance notice as possible if you need to cancel or reschedule a scheduled on-site visit, consultation, or project. Specific cancellation terms for booked work will be set out in your project agreement.

6. PAYMENT TERMS

6.1 Pricing

All prices for completed construction work will be set out in your written estimate or contract. All prices are listed in US Dollars and are subject to the specific terms of your project agreement.

6.2 Payment Methods

We accept various payment methods, which will be specified in your project agreement. Payment terms, deposits, milestone payments, and final payment schedules will be detailed in your contract.

6.3 Late Payments

Late payments may be subject to fees or interest as specified in your project agreement and applicable law.

7. PROJECT WORK AND WARRANTIES

7.1 Quality of Work

We are committed to delivering quality workmanship and customer satisfaction on every project. Specific warranty terms for any given project will be set out in your written project agreement.

7.2 Materials

Manufacturer warranties on materials (such as siding products, windows, and doors) are provided directly by the manufacturer and are subject to the manufacturer's terms.

7.3 Change Orders

Any changes to the scope of work after a contract is signed will be addressed through written change orders, which may affect timeline and pricing.

8. USER CONDUCT

While using our Services, you agree not to:

Violate any applicable laws or regulations

Interfere with or disrupt our Services or servers

Attempt to gain unauthorized access to any part of our Services

Use our Services for any illegal or unauthorized purpose

Harass, abuse, or harm another person

Impersonate another user or person

9. INTELLECTUAL PROPERTY RIGHTS

9.1 Our Intellectual Property

All content included on our website and within our Services — including text, graphics, logos, images, photographs of completed projects, and software — is the property of AZ Builders LLC or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

9.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Services for personal, non-commercial purposes.

9.3 Restrictions

THE SERVICES (MEANING OUR WEBSITE AND ONLINE PORTALS) ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

Warranties related to construction work performed under a signed project agreement are governed by the specific terms of that agreement and not by this Section 12.

13. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AZ BUILDERS LLC, ITS OWNERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES.

This limitation applies to our online Services. Liability arising from construction work performed under a signed project agreement is governed by the specific terms of that agreement and applicable construction law.

14. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless AZ Builders LLC and its owners, employees, contractors, agents, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

15. CHANGES TO TERMS OF SERVICE

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email, by posting a notice on our website, or by other means as required by applicable law. Your continued use of the Services after such notification constitutes your acceptance of the modified Terms.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 Governing Law

These Terms and your use of the Services shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

16.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or our Services shall be resolved through:

Informal Negotiations: We encourage you to contact us first to try to resolve any disputes informally.

Mediation: If informal negotiations are unsuccessful, either party may initiate mediation. The mediation shall be conducted in Douglas County, Washington.

Arbitration: If mediation is unsuccessful, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. The arbitration shall be conducted in Douglas County, Washington.

16.3 Class Action Waiver

YOU AGREE TO WAIVE ANY RIGHT TO PURSUE DISPUTES ON A CLASS-WIDE BASIS.

16.4 Time Limitation

ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO THESE TERMS OR THE ONLINE SERVICES MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE OR BE FOREVER BARRED.

Claims arising from construction work performed under a signed project agreement are governed by the dispute resolution and limitation terms of that agreement and applicable Washington construction law.

17. SEVERABILITY

If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any signed project agreement, constitute the entire agreement between you and AZ Builders LLC concerning the Services.

19. SMS COMMUNICATIONS AND TEXT MESSAGE TERMS

19.1 Age Requirement

You must be at least 18 years of age to opt in to and receive SMS messages from AZ Builders LLC. By providing your phone number and checking one of our SMS consent checkboxes, you represent and warrant that you are 18 years of age or older. If you are under 18, you may not opt in to our SMS program.

19.2 Business Identity Clause

AZ Builders LLC is a residential and commercial construction contractor providing siding, finish carpentry, window installation, door installation, and general carpentry services. By using our Services and providing your phone number while actively checking one of our SMS consent boxes, you agree to receive text messages from us as described in these terms.

19.3 Types of Messages

Non-marketing/transactional messages may include quote request follow-ups, project scheduling confirmations, on-site visit reminders, job status updates, and important business updates. Marketing messages (only sent if you opt in to the marketing consent checkbox) may include seasonal promotions, new service announcements, and special offers.

19.4 Opt-Out and Support Mechanisms

You can cancel the SMS service at any time. Just text "STOP" to (509) 668-1554. After you send "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, simply opt in again through our website form. 19.5 Carrier Liability Clause

Carriers are not liable for delayed or undelivered messages.

19.6 Message Frequency and Rates

Message and data rates may apply for any messages sent to you from us and from you to us. Message frequency varies based on your project activity. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

19.7 Consent is Not a Condition

Consent to receive SMS messages is not a condition of receiving construction services from AZ Builders LLC. You may decline SMS communication and still receive a quote and complete a project with us.

20. WAIVER

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. AZ Builders LLC's failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
